Abstract

Approach The great constitutional reform of 2005 to the Political Constitution of the Republic of Chile of 1980 revealed a considerable number of issues that have traditionally been the subject of that part of public law that is so neglected as constitutional theory. The most distinguished of these issues was the claim of the President of the Republic Ricardo Lagos Escobar consisting of the change of name of the Chilean Constitution for the "Constitution of 2005". Such presidential statement opened a debate in the written press about the legal nature of the constitutional reform of that year.
