Diagnosis and some remedies on the Spanish criminal policy

Abstract

This study assesses the recent evolution of Spanish criminal justice policy and makes proposals to improve its performance. The first part of the article is devoted to the analysis of some social facts which are playing a significant role in the configuration of current Spanish criminal policy. This is followed by a critique of some ill-founded rationales which try to justify its contents. After framing criminal justice policy within the context of public policies, the article puts forward a series of proposals mainly dealing with reforms in the sanctions system and with the modernization of the criminal judicial administration.
